THE JOCKEY ROOM LTD (“the company”)
General Terms and Conditions applicable to all persons utilising the company website:

1. The company provides an Internet website service to the public which entails offering to racing enthusiasts information, comments, analysis, guidance and forecasts (hereinafter collectively referred to as “information”) posted on the website by professional jockeys (hereinafter referred to as “the experts”) relating to horse racing events and/or the outcome of horse races.

2. The experts hold themselves out to be well informed and knowledgeable, as a result of research and/or by virtue of their association with persons involved in the horse racing industry and their own involvement in such industry, so as to be able to offer guidance to punters who speculate on the outcome of horse races.

3. If you wish to obtain information posted by an expert on the website you can only do so if you have one or more valid JCoin(s) in your voucher holder with the company. For the purchase of JCoin(s) you are required to pay a transaction fee in an amount stipulated by the company and which is advertised on the website. Each voucher accordingly has a value equivalent to the amount of the transaction fee. When the transaction fee is paid, the company issues to you a JCoin(s) in your online wallet. You use a JCoin each time that you click on a post in order to access information posted by one or other of the experts on the website.

4. Information will be posted by the experts on the website on a daily basis. Information for any particular race meeting is only accessible from 8 AM in the morning on the day of that race meet- ing and is deleted upon the conclusion of that race meeting. If you, as a racing enthusiast/cus- tomer wish to view the information posted by a particular expert for a particular race meeting you may, after 8 AM on the day of that race meeting, click on the name of that expert and you will then be required to use one of your JCoin(s) which will entitle you to view all the information posted by that expert for the chosen race meeting.

The amount of the transaction fee will be R40.00, which amount may be changed by the company at any time and from time to time and will be advertised on the website. In order to purchase one or more vouchers you will be required to deposit a sum of money, in a minimum amount of R40.00 (forty rand) into the company account with PayFast Pty Ltd, for which payment one voucher will be issued and placed in your wallet, entitling you to access one item of information posted on the website. The voucher system will be operated as follows:

4.1 each time you wish to view information posted on the website by a particular expert and click on his/her name one of your vouchers will automatically be used up, which will then entitle you to access and view the information (including forecasts) posted by that expert on the company web- site for the chosen race meeting .You may select, from the experts who advertise on the website, one or more experts of your choice, and are able to access and make use of information offered by such expert/s on the website by clicking on the name/s of the expert/s whose information you wish to view. In order to access information you must have at least one valid unused JCoin in your wallet;

4.2 you are free to purchase as many JCoin(s) as you want at any time.The transaction fee pay- able for the purchase of each voucher will be R40.00 or such other amount as may be advertised on the website from time to time. For each voucher that you use you are only entitled to view the information posted by one of the experts. Therefore, if you wish to view information posted by three experts on the same day you must have at least three valid unused JCoin(s) in your wallet.

5. All payments which you make are non-refundable and vouchers issued to you cannot be re- deemed for cash but can only be used in order to benefit from the service offered by the company, namely access to the information provided on the website by the experts.

6. Copyright in respect of all information, text, materials, graphics, software and advertisements on the website shall vest exclusively in the company.

7. All brands, images, trademarks, names, products and offerings posted by the experts or merchants advertising on the website are the exclusive property of such experts or merchants.

8. The content on the website may not be copied, duplicated or distributed in any manner and shall be utilised solely for the purpose of accessing the information and/or advertisements posted on the website.

9. By accepting these terms and conditions all users of the site acknowledge and agree that horse racing is by its very nature a speculative and uncertain activity such that neither the experts nor the company can be expected to guarantee that any forecasts concerning the outcome of horse races will prove to be accurate. All persons using the site acknowledge, accept and agree that they do so at their own risk, knowing and understanding that they shall have no claim against or re- course to the company or any of the experts should any or all of the forecasts posted on the web- site not accurately predict the eventual outcome of horse races. All users of the site automatically indemnify and hold the company and all the experts harmless in respect of any and all monetary loss, damage or expense resulting from the use of the website and/or acting upon the information (including forecasts) posted thereon.

10. The company does not guarantee the functionality of the website at any time and will not be responsible for interruption of service of any kind.

11. Although the company takes care in screening and permitting the display of information and/ or advertisements and/or other content on the site, the company does not warrant the accuracy of any of such information, advertisements or content and accepts no responsibility for any inaccuracies therein.

12. The company accepts no responsibility for any assumptions or expectations based on or derived from any of the information, advertisements or content displayed on the website. Any monetary outlay based on such information, advertisements or content is at your own risk. All information relating to the races and the horses and/or jockeys participating therein should be checked by you with an official source.

13. The company website contains links, images, offerings, products, banners and other adver- tisements to other websites operated by independent persons. Such websites are not under the control of the company or the company website and the company shall not be responsible for the content of any linked website. The company provides these links on its website for your conve- nience only. Further, the inclusion of any link on the company website does not imply and should not be construed as an endorsement or recommendation of the linked website or any of the sub- ject matter or content thereon.

14. Advertisements appearing on the company website may contain representations or offers by advertisers or merchants which you can access by linking to the advertised websites and effect- ing the desired transactions. You should refer to the advertisers themselves for all information regarding such advertisements and the related offerings, products and/or services. All such ad- vertisements, offerings, products and/or services do not emanate from the company website and the third-party advertiser is solely responsible to you for the delivery and/or quality of any such offerings, products and/or services.

15. By being a user of the company website with an active account, you acknowledge, agree and accept that advertisements and offerings linked to other websites will appear on the company website from time to time and that if you choose to link to any such websites or accept any such offerings you do so entirely at your own risk, without any recourse to the company.

16. By using the company website you automatically accept and agree to the above terms and conditions and hold yourself bound thereby.
